Terms of Service

1.1 House Rules

As a condition of entry, and for the safety and amenity of all patrons, you agree that while on the premises you shall:

• comply with all signage, ride and equipment instructions, and all reasonable directions issued by HiParty personnel;
• conduct yourself with due regard to other patrons, staff and HiParty property;
• ensure that minors are supervised at all times; persons under the age of twelve (12) must be accompanied by a responsible adult;
• refrain from entering the premises whilst under the influence of alcohol or any illicit substance, and shall not bring any outside alcohol onto the premises;
• refrain from any abusive, threatening, disorderly or unsafe conduct.

HiParty reserves the right, at its sole discretion, to refuse entry, terminate any activity or remove from the premises any person in breach of these Terms, without refund or compensation.

2.1 Third-Party Booking System

All bookings, payments and related transactions are processed exclusively through an independent third-party booking system (the "Third-Party Booking System") operated by a separate provider. By making a booking, you acknowledge and agree that your booking is additionally subject to the terms of service, privacy policy and cancellation conditions of the Third-Party Booking System, and that HiParty shall not be liable for any act, omission, error, delay or failure of that system or its operator. In the event of any inconsistency between these Terms and the terms of the Third-Party Booking System in respect of payment processing, refunds or transactional matters, the terms of the Third-Party Booking System shall prevail to the extent of such inconsistency.

2.2 Sessions and Party Packages

ColourGrid, VR Laser Tag, karaoke booths and party packages are sold as fixed-duration sessions. You must arrive no later than fifteen (15) minutes prior to the scheduled commencement of your session in order to allow for briefing and a punctual start. Sessions cannot be extended where the floor is otherwise booked.

2.3 Deposits

HiParty may require payment of a non-refundable deposit, payable through the Third-Party Booking System, to secure party bookings and full venue hire. The balance of the booking fee shall fall due on or before the date of the event.

2.4 Pricing

All prices published on our website, at the venue and on the Third-Party Booking System are quoted in Australian Dollars and are inclusive of GST. Prices and packages are subject to change without notice; however, bookings already confirmed shall be honoured at the price quoted at the time of confirmation.

• Bookings may be rescheduled at no charge provided that not less than forty-eight (48) hours' notice is given prior to the scheduled commencement, and subject to availability.
• Cancellations made within forty-eight (48) hours of the scheduled commencement shall result in forfeiture of the deposit; failure to attend (no-show) shall be charged at the full booking value.
• Where HiParty is required to cancel a booking due to equipment failure or any other circumstance beyond its reasonable control, HiParty shall, at your election, offer a reschedule or a full refund of monies paid in respect of the affected booking.

• HiParty cards are pre-loaded with credit redeemable solely for arcade play. Card balances do not expire and are not redeemable for cash.
• Tickets issued by redemption games may be exchanged for prizes at the prize counter, subject to availability. Tickets are not redeemable for cash under any circumstances.
• Lost or damaged HiParty cards may be replaced upon payment of a nominal administration fee. HiParty shall not reissue any card balance in the absence of satisfactory proof of purchase.

Certain activities offered at the premises, including, without limitation, VR Laser Tag and certain rides, involve physical exertion and may be unsuitable for persons who are pregnant or who suffer from heart conditions, back or neck injuries, motion sickness, epilepsy or other medical conditions. By participating in any such activity, you warrant that you have read and understood the applicable warnings and that you and the members of your group are medically fit to take part.

To the maximum extent permitted by law, HiParty shall not be liable for any indirect, incidental or consequential loss or damage arising out of or in connection with your attendance at the premises or use of our services. Nothing in these Terms operates to exclude, restrict or modify any consumer guarantee, right or remedy conferred upon you by the Australian Consumer Law that cannot lawfully be excluded.

You are responsible for the care of your personal belongings while on the premises. HiParty accepts no liability for any item lost, left behind or damaged within the venue. Lost property shall be retained for a period of fourteen (14) days, after which it may be disposed of at HiParty's discretion.

HiParty may capture photographs and video recordings within the premises for marketing and promotional purposes. Should you not wish to be featured in any such material, you must notify a member of staff upon arrival, and HiParty shall use reasonable endeavours to honour your request.

The HiParty name, logo, website content, venue branding and all related intellectual property rights are owned by HiParty or its licensors. You shall not copy, reproduce, modify, distribute or otherwise exploit any of the foregoing for any commercial purpose without the prior written consent of HiParty.

These Terms shall be governed by and construed in accordance with the laws in force in the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of Victoria and the courts of appeal therefrom in respect of any dispute arising out of or in connection with these Terms, your attendance at the premises or your use of our website.

HiParty reserves the right to amend these Terms from time to time. The current version shall at all times be available on this page. Your continued use of the premises or website following the publication of any amendment shall constitute your acceptance of the Terms as so amended.
